If you have children who are about to head off to college, it is important that you have their legal affairs ready for them to leave home. While you do have many other things to do, a trip to an estate planning attorney can possibly save you a lot of time and money later.
The first thing that your child needs is to make sure that he or she is protected in case of an emergency. One thing that you might want to consider is having your child sign a HIPAA release form so that doctors and other medical professionals can talk to you about your child?s health care. Once your child reaches the age of 18, you no longer have the right to be informed of what is going on. If your child does still want you to be involved in their health decisions, then a HIPAA release is necessary.
Next, you should consider getting your child a Health Care Power of Attorney and a General Durable Power of Attorney so that you, or someone else, can take care of your child?s affairs in case your child has a serious accident. It?s much cheaper to get these documents now, then to get a Guardianship latter.
